I would ID this provisionally as a male Japanese Goshawk/Sparrowhawk. The cere is lemon-green, (not orange as in Chinese Goshawk) and there is a prominent lemon eye-ring (lacking in Chinese); also the iris is pale orange not red. Where and when did you photograph it?

Hi Des. Thank you for the ID. I got this photo last April 16,2011 in the elevated portion at back of our house in Calbayog City , Samar while I was waiting to get a good perch photo of the resident black naped orioles. I was just so lucky to have my focus on this branch as this happened only in a very few seconds. This bird flew in and perched on the Caimito tree to have his meal but suddenly the Oriole couple came and chased him away. Is this a common specie in Samar? Here are other photos which might help in your ID.
